Terms & Condition

RESERVATIONS AND FINAL PAYMENTS
All reservations for the tours shown herein may be made through travel agents. Reservations will be tentatively held for 7 days from day of confirmation, and will not be considered confirmed until your full payment is received. Should the payment not reach JALPAK International U.S.A. (JPI) within the allowed time limit, reservations will be automatically cancelled.

CANCELLATIONS AND REFUNDS
All cancellations must be made in writing to JPI by the booking agent or customer and date of receipt of said cancellation will determine what penalties, if any, are to be assessed.

* In addition to the above penalties, any non-recoverable charges from our suppliers will be charged.
If airline tickets have been issued already, there will be additional non-recoverable charges in addition to the above penalties. In some cases, the airline tickets may be totally non-refundable.
To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance.

MODIFICATIONS
Any voluntary alterations of confirmed itineraries will require a non-refundable handling charge of $25.00 per request. If the request includes more than one person, the handling charge will be charged per person basis.
After the confirmation, name changes are not allowed. JPI must handle it as a new booking.

PHOTOGRAPHY
JPI reserves the right to take photographs during the operation of any program and to use resulting photographs for promotional purposes. Any passengers who prefer that their images not be used are asked to notify their tour escort at the beginning of the program or JPI agent at the time of booking.

DISCLAIMER
JPI is not responsible for any errors, omissions or misquotes contained in this brochure or any other accompanying promotional documentation. The contents of said brochure or promotional documentation may be changed anytime (including but not limited to rates and itinerary) without notice and at JPIfs sole discretion.

DOCUMENTATION

It is the responsibility of individual passengers to see that proper documentation is obtained in advance of the trip. A valid passport is required of all nationals. Nationals of countries other than the USA should check with their booking agent regarding possible visa requirements. JPI will not be responsible for alternate or additional land or air arrangements resulting from improper documentation.

HEALTH REQUIREMENTS
Currently none of the countries included in the itineraries require a certificate of vaccination. However, this is subject to change at any time. Please check with the booking agent to ascertain which, if any, countries in the tour require proof of any inoculation. It is the passenger's responsibility to take all precautions with regard to health regulations.

DISABILITIES
Some destinations in Japan may not provide facilities and/or equipment for physically disabled persons. Wheelchairs, oxygen and other medical devices may not be available.

BAGGAGE
Baggage is at "owner's own risk" throughout the tour. Baggage allowance currently in effect on Transpacific flights allows not more than two (2) pieces of checked baggage whose combined total dimensions may not exceed 106 inches (with no piece larger than 62 inches or exceeding 32 kilograms). Additionally, one (1) piece of carry-on luggage is allowed which may not exceed total dimensions of 45 inches. Excess baggage charges are strictly enforced and it is the responsibility of the passenger to pay these charges at the airport before departure. In order to avoid unnecessary delay and concern, we strongly recommend that you avail yourself of baggage insurance.

HOTELS
All hotel accommodations will be provided in hotels mentioned or in hotels of similar category. JPI will endeavor to provide the specified hotels at all times; however, due to international congresses or other events, these properties may be unavailable during certain periods. In such event, JPI will accommodate all passengers in a hotel of equal class. All hotel rooms will randomly be assigned by each hotel on a run-of-the house basis.

SIGHTSEEING, TRANSFERS, AND TIPS
All sightseeing and transfers will be conducted either by private car or on a seat-in-coach (S-I-C) basis, as indicated in each itinerary. For less than 15 passengers, scheduled transfer and sightseeing services may be used. Transfers will be by airport limousine bus. Tips in the form of prepaid service charges and all applicable taxes are included whenever practical. Tips of tour guides and drivers are not included, however consideration should be given if you request additional service.

HANDLING CHARGES
Please note that all costs quoted include handling charges imposed by JPI and our local agents. Handling charges cover the cost of communications between JPI and our overseas local operators, as well as financial transactions and currency fluctuations between the time of booking and the actual date of service rendered, the preparation and distribution of passenger documentation, and the promotion of these programs.

NOT INCLUDED
The tour does not include meals unless specifically indicated on the itinerary; service charges for obtaining passports and/or visas, foreign departure taxes; porterage, mineral waters, soft drinks, wines, and liquors unless specifically mentioned; laundry, telephone, baggage porterage; and items of a strictly personal nature. Hotel taxes are included in the land package price. Tips and gratuities to tour guides and drivers are not included.

Final destination: Japan * An additional charge for taxes and fees of up to USD 100.00 shall apply. Taxes and charges consist of U.S. International Transportation Tax, U.S. Immigration and Naturalization Service Fee, U.S. Customs Fee, Foreign and U.S. government-imposed charges, U.S. Animal and Plant Inspection Service Users Fee, Passenger Civil Aviation Security Service Fee, Passenger Facility Charge and Insurance Surcharge (Taxes and fees may be slightly different due to currency exchange rate).

Final destination: Beyond Japan *An additional charge for taxes and fees of up to USD 120.00 shall apply. Taxes and charges consist of U.S. International transportation Tax, U.S. Immigration and Naturalization Service Fee, U.S. Customs Fee, Foreign and U.S. government-imposed charges, U.S. Animal and Plant Inspection Service Users Fee, Passenger Civil Aviation Security Service Fee, Passenger Facility Charge, and Insurance Surcharge. (Taxes and fees may be slightly different due to currency exchange rate.).

LAND AND AIR COSTS
Some of these package tours that include land and air costs are shown in U.S. dollars and are based on tariffs, rates of exchange, costs, and schedules in effect as of April 1, 2007, and are subject to change without notice. Any fluctuation of currencies could result in a higher land cost. In any case, no surcharge will be imposed after a passenger is fully paid.

RESPONSIBILITY
JPI is an independent contractor and not a partner or joint venturer with any supplier of transportation or travel related services, and issues only as agent tickets and other travel documents relating to reservations, transportation (irrespective of type of carrier), lodging, tour operation, and other travel and tour related services, and shall not be responsible or liable for:
- any delayed departure, missed carrier connections, substitution of accommodations or performance of common carrier equipment, termination of services, changes in fares and rates, or cancellation or double booking of reservations or tickets beyond its control;
- late delivery or non-delivery of documents and/or tickets and the consequences thereof due to the fault of the United States Postal Service or any letter/parcel carrier which JPI elects to use;
- losses or additional expenses due to changes in any travel services, sickness, disease, weather, war, terrorism, governmental restrictions or regulations, labor unrest, mechanical or construction problems, quarantine, act of God, or other unforeseen causes outside the control of JPI; or
- death or personal injury, property damage or other loss, delay or irregularity related to travel or tours or which occur from any cause whatsoever during or as a consequence of customer's travel through any act or event outside the control of JPI.

JPI reserves the right to withdraw or cancel any tour or change any feature of any tour as it deems necessary or desirable for the benefit of the tour, with or without notice to the customer and, in such cases, any additional expense must be borne by the customer.
JPI also reserves the right to accept or reject any person as a member of any tour at any time for any reason whatsoever.
Carriers are not responsible for acts, omissions or events during the time passengers are not on board. The passage contract in use, when issued, shall constitute the sole contract between the carrier and purchaser of these tours and/or the customer.
No carrier shall have or incur responsibility or liability for any travel aside from its liability as common carrier. All fares are subject to change at any time without notice, and land costs are based on present value of foreign currencies in relation to the U.S. dollar and are subject to adjustment until time of final payment by the customer.

CAMPAIGN PERIOD
Oct 1, 2007 ~ March 31, 2008 Please provide your JMB membership number at the time of purchase. Retroactive mileage credit is not allowed. Earn 1 mile for every 2 dollars you spent on a Jalpak Discovery package identified with the JMB logo. Mileage will be credited to your JMB account approximately 2 months after the purchase of qualified packages. Your earned mileage will be returned to JPI when you cancel your trip after you receive your mileage. PURCHASE IN CALIFORNIA
RIGHT TO PROMPT REFUND
Upon cancellation of the transportation of travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously clearly and conspicuously disclosed and agreed to by the passenger, all sums paid to seller of travel, JALPAK International U.S.A., Inc. (JPI), for services not provided will be promptly paid to the passenger, unless the passenger advises JPI in writing, after cancellation. This provision does not apply where JPI has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, JPI must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.
CALIFORNIA TRAVEL CONSUMER RESTITUTION FUND
This transaction is covered by the California Travel Consumer Restitution Fund (TCRF) if the passenger is located in California at the time of payment. Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which JPI failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to JPI, not to exceed $15,000.
A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and $35 processing fee. Claimants must agree to waive their right to other civil remedies against JPI for matters arising out of sale for which you file a TCRF claim. You may request a claim form by writing to: Travel Consumer Restitution Corporation, P.O. Box 6001, Larkspur, CA 94977-6001. Transactions or purchases from outside of California is not covered by the California Travel Consumer Restitution Fund.
TRANSACTION FUNDS
California law requires certain sellers of travel to have a trust account or bond: This business has a bond issued by Fidelity and Deposit Company of Maryland in the amount of $300,000.00.

GOVERNING LAW/JURISDICTION
These Terms and Conditions are governed by California law without regard to principles of conflict of law jurisdictions for any action relating to any Jalpak travel or tour shall be in Los Angeles County, California.
